Canada Visa Refusal Reasons And What To Do Next?

Canada Visa Refusal Reasons And What To Do Next?

While it can be discouraging to have your application for a Canadian visa refused, it’s essential to find out why and consider your options. You want to know the Canada visa refusal reasons and your next steps.

Your visitor visa application was refused. Should you apply again?

Look at your refusal letter (2nd page); here is the IRCC’s note:

«Your new application may be refused unless it is supported by new or different information that would satisfy the officer that you meet all application requirements.»

If you decide to apply again, know that your new application may be refused unless you can include information you didn’t include before that would satisfy the officer that you meet all application requirements. This means that applying again with the same information will not change this decision. Your application may be refused because the official deciding your case has reason to believe you’ll stay in Canada beyond your authorized stay or you’re inadmissible to the country. Applying a second time will not change this decision. It will only cost you more money and increase processing times for other applicants. However, if your situation changes, you may apply again with your new information.

Next Steps: Our Visa Refusal Services

Understanding your visitor visa application refusal and what to do next is essential. If you were refused a visitor visa to Canada, DON’T GIVE UP HOPE! One of our RCIC areas of expertise is Canada Visa Refusal. He has helped many clients obtain a visa after a rejection, often after multiple rejections. This is his area of expertise.  Arnika Visa assists clients in understanding the reasons for their visa rejection. Please consult with our RCIC or on your choice, for your assistance to help you overcome your visa refusal.

Suppose you believe that you submitted a solid immigration application, and the IRCC officer made an error in law or fact, or they made an unreasonable or unfair decision. In that case, you can make an appeal for visa refusal to the Federal Court. If your rejection decision has been made within Canada, you will have 15 days from the date of the rejection letter to file a Judicial Review at the Federal Court. The delay is 60 days if the decision arises from outside of Canada. Our Immigration lawyer can appeal the IRCC decision if you want to proceed with this option.

Most common reasons for visa rejection Canada

  • Lack of Ties to Home Country: If you cannot show close ties to your home country, you may be denied entry into Canada for an extended period, one of the most frequent grounds for rejection.
  • Insufficient Funds: Your application may be refused if you cannot prove that you will have enough cash to pay for your stay’s expenses.
  • Incomplete Documentation: Refusals may result from any missing or insufficient documentation. Make sure to provide the necessary documentation accurately.
  • Criminal History: A criminal history, particularly of severe offences, may lead to visa denial.
  • Travel History: It may be cause for concern if there is a lack of travel history or if other nations have already rejected you.
  • Misrepresentation: Giving fraudulent information or documentation may result in an instant rejection and possible ban from future applications.
  • Unclear Travel Intentions: Your application may be refused if your paperwork does not support the purpose of your visit or if your travel intention is not made apparent.

The following steps after Canada Visa Refusal

Here are important steps you can take if your Canada visa application is refused:

1- Review the Canada visa refusal letter and Reflect

Before reapplying, review your prior application, the reasons for rejection, and your revisions. Use this knowledge to strengthen your applications in the future and take care of any problems that might have caused the rejection.

The precise grounds for the visa denial will be detailed in the Canada Visa Refusal reasons letter you get from the Canadian authorities. You’ll need to thoroughly read and understand these reasons, as they will show which parts of your application were judged inadequate.

For instance, if your letter mentions misrepresentation, please hold off until five years have gone since you were rejected. If your letter says a criminal history or inadmissibility, you might need to take steps to overcome the inadmissibility.

2-Understand the Canada visa refusal reasons

Identify the specific reasons for the refusal. For Example, if :

Your letter refers to misrepresentation

If misrepresentation is why you were given, the phrase “inadmissible for misrepresentation” will appear in the final sentence of your decision letter. It indicates that the officer found that you submitted forged or manipulated documents and gave misleading information or omitted material during an interview or on your application. If someone else provided fake documents or lied, it makes no difference. Even if your agent fills out your application, you are still in charge of all the information on it.

It will take you at least five years to be able to enter Canada. I think it would be beneficial if you held off on reapplying for five years after the letter’s date. Your application will be rejected if submitted before the five years have passed. You won’t be able to enter.

Your letter refers to a history of criminal activity or criminal inadmissibility

You could not be permitted to enter Canada if you have committed certain acts, offences, or convictions in your home country or Canada. This indicates that, in terms of Canadian immigration law, you are “inadmissible.” This covers both severe and insignificant offences.

If the IRCC rules that you are criminally inadmissible, you have enough time to appeal. You might be considered rehabilitated for some offences if enough time has elapsed. But you must apply for criminal rehabilitation.

3. Address Canada visitor visa rejection reasons and Reapply

Should your application be rejected, the decision to reapply with identical details will stand. If the IRCC official reviewing your case has grounds to suspect that you are inadmissible to Canada or that you will stay in the country longer than permitted, your application may be refused.

Reapplying will result in the same outcome. It will only result in more expenses for you and extended processing periods for other candidates. If your circumstances change, you can apply with the updated details.

You may need to apply again and take corrective action based on the reasons for the rejection. You can apply for a visitor visa to Canada if you have addressed the Canada Visa Refusal reasons that caused the first rejection. Please ensure all relevant paperwork is included, and if you need an explanation, ensure it is well-prepared.

Please don’t hesitate to fix any errors and apply again if the rejection was brought on by incomplete or missing paperwork. Ascertain that all required paperwork is submitted and that the issues brought up in the rejection letter are resolved.

If your situation has not changed since you applied

Before attempting to reapply, it would be beneficial to address why your application was denied and demonstrate that your circumstances have changed or that you have significant new information to provide.

Nothing may change for you. You may be turned down if you reapply.

You still won’t have enough money for your stay in Canada, for instance, if your application was turned down because you needed more to pay for your travel expenses and your departure from Canada at the end of your visit.

You should present further proof to ease the rejection if it stems from worries about your ties to your home nation or the reason for your trip. This might include proving that you have strong ties to your nation of origin, outlining the purpose of your journey, or sharing further details about your past.

If your situation has changed

If you reapply, tell IRCC of any changes in your circumstances. Your situation must be reflected in the documentation you provide. You must present documentation with specifics that demonstrate, for instance, that you have stable employment with solid pay or additional connections, like family or financial holdings.

The IRCC examines your application and looks for a link between the data you provided on your application form and the information in the supporting documentation.

Additional Steps to Consider

  • Proof of Strong Ties to Your Home Country: Highlight your close ties to your home country while reapplying. Provide more proof of your plan to return after your vacation, such as employment letters, property ownership certificates, or family responsibilities.
  • Financial Documentation: Provide thorough bank statements, job letters, and other proof of your ability to pay bills if money were an issue.
  • Be Transparent: When reapplying, be open and honest about the reason for your prior rejection. Explain how you resolved the problems that caused the denial and attach any supporting evidence you feel is needed.
  • Seek expert advice: You might want to speak with an immigration specialist if you’re not sure how to strengthen your application or deal with the problems that caused the rejection.

4. Appeal Canada Visa Refusal Decision

You could challenge the IRCC’s decision under specific circumstances. Check the Canada Visa Refusal Reasons letter and the immigration regulations to see if you qualify for an appeal, as not all visa rejections are. If eligible, proceed with the immigration authorities’ recommended appeals procedure.

5. Consider Alternative Plan

If your visa category is difficult for you, investigate other possibilities that might work better. Canada provides a range of visas for various uses, including work permits, study permits, and permanent residence.

6. Seek professional advice

It could be helpful to speak with an immigration lawyer or consultant specializing in Canadian immigration if you’re unclear about the grounds for rejection or how to respond. They can provide you with tailored guidance according to your circumstances. You can get assistance from an immigration specialist in creating a robust visa application. They can give you advice on how to make your case more compelling.

Important consideration

  • Nobody can guarantee a visa: Don’t believe anyone who claims to be able to expedite your application or acquire a visa for Canada, such as an immigration specialist or agent. The likelihood that your application will be accepted will not be increased by working with an immigration agent or other professional. Before reapplying, carefully evaluate your options, as application fees are non-refundable after processing your application. Even if someone else fills out your application, you are still responsible for all its data. For advice on locating a certified representative and guarding against fraud, see How to Select an Immigration Representative.
  • Be patient: Every situation is different, and the immigration procedure might be complicated. The reapplication procedure must be approached with diligence, patience, and a proactive attitude.
  • Personalize your application: Every visa application is different, and the optimal line of action could vary depending on your case’s particulars. To improve your Chances Of Getting a Canada Visa After Refusal, it’s imperative that you thoroughly review the Canada Visa Refusal reasons letter and, if necessary, seek expert guidance.

Conclusion

If your second application is also turned down, you should investigate the issues more thoroughly and submit a stronger one. Consider getting expert assistance to ensure your application is as strong as possible.

How Can We help with your TRV Refusal?

If you were refused a visitor visa to Canada, don’t give up hope! Numerous clients, frequently after multiple visa rejections, have been assisted by us in getting visas. One of our RCIC areas of expertise is Visitor Visa Refusal. He has helped many clients obtain a visa after a rejection, often after multiple rejections. This is his area of expertise.

A TRV application may be refused for several reasons. Still, one of the primary ones is that the applicant will enter Canada and decide to stay after their visit. To prepare solid and well-documented applications that adequately reflect the purposes of the visit to Canada and support the issuance of a TRV, Arnika Visa assists clients in understanding the Canada Visa Refusal reasons. In addition to ensuring the application is complete, there are areas where our RCIC can help you overcome your visa rejection:

  • Get GCMS Notes And Examine Them: The whole case history is kept in the Global Case Management System (GCMS), the information system IRCC uses to handle visa applications. They comprise the notes the visa officer typed into the application review system while deciding. They also provide priceless insight into the immigration officer’s evaluation of the situation and justification for the choice. According to GCMS, the letter can help you determine the cause of the rejection, allowing you to address the issue by making the necessary changes and giving extra information to enhance your application if the IRCC visa officer has concerns.
  •  Private Secure Cloud-Based Online Data Collection and Document Sharing and Management: Clients can see online the secured case we present for their application. They can review the forms and supporting documents before submitting their application to the IRCC.
  • Professional Representation: You will likely only submit the documents listed on the IRCC document checklist. Simply providing those documents is often insufficient to convince the IRCC visa officer that you will return to your home country after your visit and meet other conditions for obtaining a visitor visa. Presenting more evidence than what the IRCC requires is often a good idea. To address the visa officer’s concerns regarding your prior application, we, as your authorized representative (RCIC), can help you make and submit a more convincing application to IRCC.
  • Submission letter: On your behalf, our RCIC will write and submit a submission letter with the application. The visa rejection letter’s response and explanation will address the grounds for refusal mentioned in the GCMS note and the rejection email. Arnika Visa typically drafts a 4-5 page submission letter presenting each client’s application, highlighting the necessary facts to address all reasons for rejection.
  • Using Authorized Representative Portal: This portal allows authorized paid representatives (APRs) to complete, pay for, and submit online applications on behalf of their clientsThe IRCC visa officer can see the application is submitted through an authorized Representative Portal, including a well-drafted personalized submission letter. In most cases, working with an expert RCIC to prepare and resubmit a solid application and presenting the case leads to approval.
  • Benefiting Expertise of Professional RCIC: The IRCC visa officers realize that RCICs are well-informed about immigration regulations and know procedural fairness and due diligence procedures that IRCC officers must follow. If not, the client will request a federal court review of the visa officer’s decision.

According to our experience, combining the reasons suffices to get past most rejections, particularly the more regular or prevalent ones. We can help if you’ve been denied your application for a visitor visa. If your TRV application was refused or you wish to apply for a new one, please contact our Immigration firm for professional help. At Arnika Visa, we can assist you in resolving your Canada Visa Refusal reasons through our expertise to guide you in the right direction. Finally, we can handle your entire Canadian immigration process.

Hello, I applied for a Canadian tourist visa through one of the famous travel agencies in Iran. I have 15 years of experience as a lawyer and three trips to European countries. I had previously applied for a Canadian student visa, but I was rejected because the reason for my return was unclear. My parents are in Iran. I have a good job and an office in Iran. I provided financial resources of $70K. In addition to my supporting documents, the travel agency added an invitation letter from a Canadian tourism office to my visa application, but it was rejected again. They suggested sending my application again, but I want to try my chance in a better way, which might be the last chance. Thank you for checking my condition and giving your opinion.

Hello, my visa application was rejected. I had applied for my wife and two children, and all were rejected. I have a good travel history (a Schengen of France and Spain, Dubai and several cities in Turkey); I had a great job and two businesses in Iran. The officer refused only for the following reason

The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.

What services do you provide to solve my rejection, and how much are the costs?

I applied for a tourist visa for my wife and children in September, but unfortunately, they were rejected. We also got the answer from the officer’s note: you don’t have family ties outside Canada, and they are not satisfied with leaving the country. Considering I have a visa and OWP, what is the best way to fix it?

    1. Avatar of Admin

We recommend addressing the officer’s concerns by providing additional evidence of strong ties to your home country, such as property ownership, employment stability, or other family commitments, plus social or community ties. Highlight the temporary nature of the visit and assure the officer of their intent to return. Consult an RCIC for further expert guidance if needed.

I applied to come alone with 14,000$, but unfortunately, it turned out like this. I am completely confused, and I don’t know what to do. The agency got the money and needs to answer my questions afterward. Mr.Eslami, Can you get an officer’s note? Is it free? If I know, I can send you my documents and fill out the evaluation form.

We can use this to supplement your application, providing a comprehensive perspective for the authorities. Let’s collaborate on this strategy for a stronger appeal.

My father lives in Canada and holds a valid work permit. He invited me to meet him, but I was rejected due to a lack of ties in my home country and strong ties to Canada, as the IRCC officer mentioned. What can I do? Thanks

I’m a full-time student, but I work on the side. my regular salary per month is normally 2k+ Canadian, and when I applied, I had 10k Canadian in my bank statement. I said I would bring 5k Canadian as my allowance for my trip. My visa has been refused, stating your application was refused because you have not established that you will leave Canada, based on the following factors:

    • Your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable).

I applied for a worker visa under CUAET and was rejected because I needed to provide the necessary information on time. The problem is that when the visa officer requested information, they failed to provide me with the deadline. I tried looking for the information on the deadline, neither on the website nor in my account, nor in the letter where they asked to provide additional information. I am gathering all the documents they requested and wanted to know if there’s an option to appeal that unfortunate decision.

    1. Avatar of Admin

I understand your frustration. To appeal the decision, clarify in your appeal letter the absence of a specified deadline in the officer’s request. Highlight your efforts to gather required documents promptly. Seek professional advice to strengthen your case. Best of luck.

I applied for a TRV on 23 May 2023, got a fairness letter in October 2023, and responded very carefully (it was regarding a USA visa denial 2016, which I overlooked). Still, to my surprise, I got a refusal letter on 24 January 2024. I have been to Canada several times and have been granted a visa twice before. I still have a valid visa in my old passport, which is full but not expired (visa expiring in late 2024); I got a new passport, and I thought I would apply for a fresh one so that I don’t need to be moving with both passports all the time, I had applied as a principal applicant together with my daughter, in October 2023 my daughter was approved the visa and a week later I received a fairness letter, the only reason I want to be visiting Canada every six months is because I got my daughter studying in Toronto. I want to send my second daughter. I am disturbed by the turn of events. Thanks a lot.

    1. Avatar of Admin

You can appeal the TRV refusal decision within 60 days of receiving the refusal letter. Ensure your appeal addresses the concerns raised in the fairness letter and provides strong evidence of your ties to your home country, including your daughter’s studies in Toronto. Emphasize your past compliance with visa conditions and the genuine purpose of your visits. Seek assistance from a qualified immigration lawyer or RCIC to strengthen your appeal.

My family and I had applied for a Canadian visit visa. Unfortunately, the visit visa was refused, and so was the reconsideration request, which shocked me as I had presented a well-prepared, documented application followed by a reconsideration request supported by reasonable documentation. I now believe there is an option to review but an appeal to the immigration tribunal. I have a well-established business in the UAE for the past 17 years, owning property, etc., and have strong links to the country of my residence. I can share with you an index of the list of documents submitted. Hope to have your reply asap.

Hi, we recommend carefully reviewing all documents to ensure completeness and relevance. We also advise consulting with an immigration lawyer to assess the feasibility of an appeal and to prepare a strong case, highlighting your extensive ties to your home country.

My spouse’s open work permit application was refused because I needed to submit sufficient information to show that she is a full-time student in an approved program at a DLI. I realized I needed to submit her proof of enrollment. She’s pursuing a diploma program at a college. What can I do?

Submit the required proof of enrollment for your spouse’s diploma program at the college. Ensure all necessary documentation is complete and accurate before reapplying for her open work permit. Consulting with an immigration professional can provide further guidance and support.
