In December 2023, Mr. Yogesh’s company, RCIC, submitted a closed work permit (Employer-specific) extension application while awaiting his Labour Market Impact Assessment (LMIA) and Certificat d’Acceptation du Québec (CAQ) approvals.
Unfortunately, due to a payment issue with the employer’s CAQ application, both documents were delayed. As a result, IRCC refused his work permit on February 29, 2024, citing the absence of a valid LMIA and CAQ at the time of submission.
This work permit refusal caused his legal status to expire, and he was advised to apply for restoration of status within 90 days.
Acting in good faith, he applied to restore his visitor status while waiting for the LMIA and CAQ to be approved. By May 2024, both documents were issued. However, IRCC refused his restoration application on August 14, 2024, explaining that, under section R182(1) of the Immigration and Refugee Protection Regulations, one can only restore the status they held immediately before; since he was a worker, not a visitor, restoration to visitor status was not possible.
