visa refusal appeal letter FAQ

Sample appeal letter for visa refusal FAQs

How to submit a reconsideration request to IRCC?

If you are still determining where to send your visa refusal appeal letter, you should utilize the Webform. The Webform is an online means of contacting Immigration, Refugees and Citizenship Canada (IRCC). Upload additional or new files, such as a revised offer letter, additional financial statements, a change to or removal of a representative, etc.

What is the appeal letter for Canada visa refusal processing time?

The IRCC will forward your visa refusal appeal letter to your country’s appropriate visa processing office. After reading your letter, a higher-ranking officer who handles visa reconsideration requests will determine whether to review the denial of your visa application. The IRCC has different processing times for reconsideration requests. They must notify you of this choice and any other actions you might need to take.

What happens if my visa is rejected multiple times?

If you applied more than once and kept getting turned down for a visa, your application may not be correct, or you may not be eligible for the desired visa. Therefore, your visa will be denied again if you reapply with the same errors as the first time.

If you cannot correct these errors on your subsequent visa application, contact Arnika Visa and request guidance on Canada Visa Refusal Reasons And What To Do Next.

Even if there’s a chance, you can also try to apply for different kinds of visas in case your current one is denied or if trying again doesn’t work.

What is the reconsideration Canada visa processing time?

When you lodge the reconsideration letter, the IRCC office will read it. Once they have gone through what you wrote in your letter, the IRCC officer will decide whether to reverse the decision on your visa application. The processing time for the appeal letter varies from country to country. However, you will be notified once they receive your letter, and a decision has been reached.

What if my visa reconsideration letter is refused?

If the IRCC refuses your appeal letter, you must seek other alternatives. For example, you can either reapply for the same visa or explore other types of visas or immigration pathways to Canada.

If you choose to reapply, be aware that your application can be rejected unless you can provide previously withheld material that would persuade the officer that you fulfill all application conditions. This implies that reapplying with identical details won’t make this decision different. If the person reviewing your case has grounds to suspect that you are inadmissible to Canada or that you will stay in Canada longer than permitted, your application may be denied.

Reapplying won’t make this decision change. It will only result in higher expenses for you and longer processing times for other candidates. If your circumstances change, you can reapply with the updated details. It is important to know that submitting a new application does not guarantee that your visa will be approved.

What if my letter of appeal is approved?

If the IRCC officer approves your reconsideration letter, you will receive a notification like you were notified of the visa refusal. Once your appeal letter is approved, you can receive a passport request letter, which requires you to send your passport along with this letter to the Canadian embassy, which is designated for your home country, to stamp your visa on your passport, which enables you to travel to Canada for the travel purposes which was intended to.

how long after visa refusal can I reapply for a new visa?

If your Canada visa has been rejected, you can apply anytime since there is no specific rule on how long you should wait before reapplying for a new visa. However, it is recommended that before submitting the new visa application, you should find the Canada Visa Refusal Reasons and correct the errors by adding the new information and supporting documents. This way, you can avoid getting another visa rejected.

Does visa refusal affect my future visa applications?

Your second visa application will not be guaranteed to be denied just because your first was. You can increase your Chances of getting Canada visa after refusal by correcting the errors you made in the previous application once you have been informed of why it was denied.

I applied for a TRV on 23 May 2023, got a fairness letter in October 2023, and responded very carefully (it was regarding a USA visa denial 2016, which I overlooked). Still, to my surprise, I got a refusal letter on 24 January 2024. I have been to Canada several times and have been granted a visa twice. I still have a valid visa in my old passport, which is full but not expired (visa expiring in late 2024); I got a new passport, and I thought I would apply for a fresh one so that I don’t need to be moving with both passports all the time, I had applied as a principal applicant together with my daughter, in October 2023 my daughter was approved the visa and a week later I received a fairness letter, the only reason I want to be visiting Canada every six months is because I got my daughter studying in Toronto. I want to send my second daughter. I am disturbed by the turn of events. Can I send an appeal letter for visa refusal to be reconsidered? Thanks a lot.

    1. Avatar of Admin

You can appeal the TRV refusal decision within 60 days of receiving the refusal letter. Ensure your appeal addresses the concerns raised in the fairness letter and provides strong evidence of your ties to your home country, including your daughter’s studies in Toronto. Emphasize your past compliance with visa conditions and the genuine purpose of your visits. Seek assistance from a qualified immigration lawyer or RCIC to strengthen your appeal.

When we submitted my first application, we also sent notarized proof of funds attached to the affidavit of support from my boyfriend, stating all costs would be covered. Also, my boyfriend is separated and has alternating custody of his dogs, which he flies back to Canada every two months to honour and spends the “off” months with me travelling. For our first 1.5 months, we explored the Philippines; for the second 2 months, we stayed in Bali, etc.; now we are in Malaysia and will head to Japan once our month ends. We are serious, and he happily pays for everything during all our time together. Also, I need help logging in to my Canada account, but my refusal date was roughly in the last week of Nov 2023. What can we do?

Hello, I am an employee of the National Bank, and my wife is a nurse. We have a 4-year-old daughter. We applied for a Canadian tourist visa and put our daughter as a guarantee to prove we would return to our home country. This decision was also made in consultation with a travel agency. Unfortunately, we were rejected. In your opinion, our mistake was that we did not add our daughter to our immigration application or not. Can we send an appeal letter for the reconsideration? Thank you for your guidance.

    1. Avatar of Admin

Your mistake may have been relying solely on your daughter as a return guarantee for your tourist visa. It didn’t make sense to leave a child of that age alone or even with your parent in the home country as the tourist visa is not an emergency matter to come to Canada. So, we suggest consulting an immigration expert (RCIC) for tailored advice.

I am writing to ask for guidance regarding the refusal of my visitor visa application. I have applied for the visa twice, and it has been refused both times, despite having an upcoming industrial electrician exam in Ontario on the 28th. The reasons for refusal seem unjustified and do not make.

    1. Avatar of Admin

Seek guidance from an RCIC expert in visa refusal to understand the reasons for refusal. Provide evidence of strong ties to your home country, clarity on your visit’s purpose, and documentation for the upcoming exam. Ensure accuracy and completeness in your application. Consider reapplying with a stronger case.

My family and I had applied for a Canadian visit visa. Unfortunately, the visit visa was refused, and so was the reconsideration request, which shocked me as I had presented a well-prepared, documented application followed by a reconsideration request supported by reasonable documentation. I now believe there is an option to review but an appeal to the immigration tribunal. I have a well-established business in the UAE for the past 17 years, owning property, etc., and have strong links to the country of my residence. I can share with you an index of the list of documents submitted. Hope to have your reply asap.

    1. Avatar of Admin

Hi, we recommend carefully reviewing all documents to ensure completeness and relevance. We also advise consulting with an immigration lawyer to assess the feasibility of an appeal and to prepare a strong case, highlighting your extensive ties to your home country.

My wife and I applied for a Canadian visit visa. We provided all the necessary documents and an invitation letter from my younger brother, who lives in Canada having PR. But been refused with clause form 179b that your visit plan is not consistent, and we think you will not leave Canada after your short stay even though we told them that we are not taking our three children with us.

    1. Avatar of Admin

We understand your frustration with the recent visa refusal. It appears the immigration officers have concerns regarding the consistency of your visit plans and the likelihood of your return to your home country. To address this, you must further emphasize your strong ties to your home country in future applications. This could include showcasing stable employment, property ownership, or other significant commitments demonstrating your intention to return after your visit. Additionally, providing a more detailed itinerary or explaining your visit’s purpose might alleviate their concerns.

    Hi my name is Patrick, i live in Canada, i would like to have your advice on 2 Visa refusal cases;
    1. My Nephew’s study permit was recently rejected, because he didn’t mention in the application that he was denied a visitor visa to USA. he is about to reapply but he is not sure if he will make an apology in the new application or recognizing the mistake because he had in mind that he had responded YES to the question, but by mistake he put NO.

    2. I have a friend of mine, he was refused a study permit because of their financial capacity. yet, he had submitted sufficient financial documents including Bank statement, properties, etc, and paid a deposit fee of 9,000CAD as requested by Algonquin College. She wants to make an appeal for reconsideration. IS it worthy to appeal the decision or she needs to start a new application?

    Regards,

    1. Avatar of Admin

      Hi Patrick,

      Here are your answers:

1-Your nephew should acknowledge the mistake in his new application and provide a sincere apology and accurate information about his visa history.

2- Your friend can consider appealing the decision to the federal court rather than reconsidering it. We always suggest starting a new application as it is faster than federal court.

      Good luck

My consultant ordered GMC Notes, and it was mentioned that it had been refused or analyzed by the hip of Chinook software. We have provided all the necessary documents. Therefore, she advised me to go through the reconsideration process. Now my question is, does it really help to get a positive result? It’s been two months now for reconsideration, and there has been no update yet.

I ordered GCMS note to know the original reason which came April 8, 2024. The officer’s reason for the refusal was that” my proof of fund was $17,700CAD which is low for me to pay tuition, living expense and transportation.” Meanwhile I had $29,000 CAD in my statement closing balance which also started in the GCMS note pre-assessment note. The officer made error by lowering my proof of funds that was initially verified when they were confirming my bank statement. That’s the only reason the officer refused my application. Please can I send a reconsideration letter for this?

    Hello Eslami,

Greetings! I am from India. I had applied for a visitor visa on 18 March, 2024 for myself and on my behalf of my wife to meet our daughter who is an international student in Montreal since Aug 2023. I have extensive travel history including travels to USA and Canada. Currently I hold a valid US b1/b2 visa, while my Canada visa has expired recently. As for my wife, she had just 1 visit to Europe in the last 5 years and her Canada visitor visa for tourism was refused twice in 2023. The refusal reasons were 1) Assets and financial situation are insufficient 2) Lack of significant ties to home country 3) Purpose of visit was not consistent. In spite of providing detailed explanation with all the supporting documents to address three concerns, her visa was refused in the second attempt too. Since her visa refusal, now she has a full time job and also a valid US b1/b2 visa. We both will be traveling to USA on June 21, 2024 and from there we intend to meet our daughter and spend a week with her if our visa is approved. Our both applications still show as in-progress while the stated processing time is 21 days. Please advise would it be a good idea to raise a web form to request for the application status? Thanks.
